Introduction

Properties auctioned through Dubai Courts or platforms like Emirates Auction offer attractive price points. However, purchasing distressed assets requires legal caution.

How Foreclosures Work Under UAE Mortgage Law

Law No. 14 of 2008 sets out the foreclosure process. When a borrower defaults, the mortgagee bank serves a 30-day notary notice. If unpaid, the bank applies to the Execution Judge for an order to auction the property.

Risks and Due Diligence for Auction Buyers

  • Unpaid Service Charges: Outstanding HOA fees may remain attached to the unit.
  • Sitting Occupants/Tenants: Evicting previous owners or tenants who refuse to vacate requires separate court execution orders.
  • Physical Condition: Auction properties are sold 'as-is' without snagging warranties.

Clearing Liens Post-Purchase

Once full auction payment is deposited, the Execution Court issues an official decree canceling all previous mortgages and directing the DLD to issue a clean Title Deed to the bidder.
