Rent Increase in Dubai: How Much Can Your Landlord Charge?

A Dubai landlord can raise the rent only at renewal, only within the legal cap, and only with at least 90 days' written notice. Miss any one of these and the increase can be challenged.

The three tests for a lawful rent increase

  1. Timing — The increase can only apply when the contract is renewed, not mid-term.
  2. Notice — The landlord must give written notice at least 90 days before the contract expires, unless the contract validly provides otherwise.
  3. Amount — The increase must be within the cap set by Decree No. 43 of 2013, measured against the official rental index.

The Decree No. 43 of 2013 caps

Current rent compared with the index averageMaximum increase
Up to 10% belowNo increase
11–20% below5%
21–30% below10%
31–40% below15%
More than 40% below20%

If your rent is already at or above the index average, no increase is allowed at that renewal.

The Smart Rental Index

The Dubai Land Department launched the Smart Rental Index in January 2025. It sets the average rent for similar properties using location, building classification and contract data. The Smart Rental Index decides the average; Decree No. 43 of 2013 still sets the percentage caps. You can check your property on the Dubai REST app or the DLD website. (Mondaq, Khaleej Times)

What to do if you receive a rent increase notice

  1. Check the date. Was it served at least 90 days before expiry?
  2. Run the Smart Rental Index calculator for your property and save a copy of the result.
  3. If the increase exceeds the cap, reply in writing and propose the lawful figure.
  4. Keep paying your current rent on time.
  5. If the landlord won't agree, file at the Rental Dispute Center, or let us file for you.

For landlords

We help landlords set a lawful increase, serve valid notice and, where the market has moved beyond the index, explore the legal routes available. A defective notice usually means waiting another full year.

Frequently asked questions

What happens if my landlord didn't give 90 days' notice?

The rent generally stays the same for the new term, even if the index would have allowed an increase.

Can my landlord increase the rent every year?

Only if the index allows an increase at each renewal and valid notice is served each time.

Can my landlord evict me if I refuse an unlawful increase?

No. Refusing an unlawful increase is not a ground for eviction.
