Introduction

Expatriates own a significant proportion of Dubai real estate. Without a legally registered will, property inheritance can become tied up in lengthy local probate processes.

Federal Decree-Law No. 41 of 2022 on Non-Muslim Personal Status

This law established that civil principles govern inheritance for non-Muslims, allowing property owners to distribute their estates according to their wishes rather than mandatory default statutory shares.

The DIFC Wills Service: The Gold Standard

The Dubai International Financial Centre (DIFC) Wills Service allows non-Muslim expatriates to register an English-language Real Property Will covering their UAE real estate. Upon death, probate orders are issued directly by DIFC Courts for immediate execution by the DLD.

Joint Ownership and Bank Freezes

In the event of a co-owner's passing, UAE bank accounts and jointly held property titles may be frozen until probate is concluded. A registered will eliminates these delays and protects family members.
