Introduction

A Power of Attorney (POA) authorizes a representative to act on your behalf in property matters. While practical for overseas owners, real estate POAs carry strict legal requirements in Dubai.

Strict RERA Restrictions on Real Estate Agents

To prevent conflicts of interest and fraud, RERA regulations strictly prohibit real estate brokers from acting as the POA holder for their own clients during property sales, or receiving sale proceeds in their personal accounts.

Drafting Requirements for Dubai Trustee Offices

Registration Trustee offices will reject general, non-specific POAs. The document must explicitly specify:

  • The exact property plot, building, and unit number.
  • Authority to represent before DLD and sign transfer instruments.
  • Clear instructions regarding receiving manager's cheques.

Cross-Border Attestation Procedure

If executed outside the UAE, the POA must be:

1. Notarized in the country of origin.

2. Attested by the home country's Foreign Ministry.

3. Attested by the UAE Embassy abroad.

4. Attested by the UAE Ministry of Foreign Affairs (MOFA) and legally translated into Arabic.
